Respondeat superior is a Latin term meaning “let the master answer.” It is a legal doctrine that holds employers or principals liable for the wrongful acts or omissions of their employees or agents when those acts occur within the scope of their employment or agency. Essentially, it imposes vicarious liability on employers for the actions of their employees or agents performed in the course of their employment or agency relationship. This doctrine applies to situations where an employee commits a wrongful act, such as negligence or misconduct, while carrying out their job duties, and the employer is held responsible for any resulting harm or damages. Respondeat superior serves as a basis for holding employers accountable for the actions of their employees and encourages employers to maintain proper supervision and training to prevent wrongdoing.
