Define: Retrial

A retrial is a legal proceeding in which a case that has previously been tried is heard again, typically due to specific circumstances such as an appeal, a mistrial, or new evidence coming to light. During a retrial, the case is presented before a new judge or jury, and the parties involved have the opportunity to present their arguments and evidence once again. The purpose of a retrial is to ensure that justice is served, either by correcting errors that occurred during the original trial or by considering new information that may affect the outcome of the case. Retrials may result in the same verdict as the original trial, or they may lead to a different outcome based on the presentation of new evidence or a different interpretation of the law.

A new trial in which issues already litigated and to which the court has already rendered a verdict or decision are reexamined by the same court; occurs when the initial trial is found to have been improper or unfair due to procedural errors.
