Sovereign Immunity
Quick Summary of Sovereign Immunity

Sovereign immunity is a legal doctrine that protects governments and their entities from being sued without their consent. Originating from the idea that the sovereign or state cannot be held liable for its actions, sovereign immunity shields governments, including federal, state, and foreign governments, from civil lawsuits and legal claims for damages. This immunity may extend to government officials acting within the scope of their official duties. While sovereign immunity is a fundamental principle in many legal systems, exceptions and limitations may exist, allowing individuals to pursue legal claims against governments under certain circumstances, such as when governments engage in commercial activities or waive their immunity explicitly.

Full Definition Of Sovereign Immunity

Sovereign immunity is the concept that the government is immune from legal actions. Although this rule historically was more absolute and did not allow the federal, state, and local governments to be sued, different governments have waived liability in differing degrees under certain circumstances.

Because of sovereign immunity, it is very difficult to recover injury from a governmental body or sue for damages. If you have been injured by a government employee who was performing their job duties, such as a police officer, it is best to talk to an injury lawyer to determine what rights and remedies you have under the law.
