Libel per se refers to statements or written communications that are inherently defamatory and do not require additional proof of harm to the plaintiff’s reputation. These statements are considered so obviously damaging that their defamatory nature is assumed by the court without the need for further evidence. Examples of libel per se include false accusations of criminal activity, allegations of serious sexual misconduct, claims of serious professional misconduct, or statements that harm a person’s reputation in their trade or profession. In cases of libel per se, the plaintiff may be entitled to damages without proving actual harm to their reputation, simplifying the legal process for defamation claims.
