Define: Statutory Tenancy

Statutory tenancy refers to a legal arrangement that arises when a tenant continues to occupy a property after their original lease or rental agreement expires. In some jurisdictions, statutes or laws provide tenants with rights to remain in the property under certain conditions, even if a new lease agreement has not been signed. These conditions may include the tenant’s continued payment of rent and the landlord’s acceptance of rent payments. Statutory tenancy typically grants tenants similar rights and protections as those outlined in the original lease agreement, although specific terms may vary depending on local laws. This legal concept ensures that tenants are not unfairly displaced and provides stability in housing arrangements.

A statutory tenancy is any lease which has remained in effect, with or without the consent of the landlord, after the original tenancy agreement has expired. There was a time when a statutory tenancy could continue indefinitely, whether the landlord wished to recover the property or not.
