Define: Cotenant

A cotenant is an individual who holds concurrent ownership rights with one or more other individuals in the same property. Typically, cotenants have equal rights to possess, use, and enjoy the property, although their specific rights may vary depending on the type of cotenancy arrangement. Common types of cotenancy include joint tenancy, tenancy in common, and tenancy by the entirety. Each cotenant has a duty to contribute to the property’s expenses, such as taxes, maintenance, and repairs, in proportion to their ownership interest. Additionally, cotenants owe each other a duty of good faith and fair dealing, including the obligation to obtain consent before making significant changes to the property or transferring ownership interests.
