Define: Aggravated Trespass

Aggravated trespass is a criminal offence that involves unlawfully entering or remaining on someone else’s property with the intent to intimidate, obstruct, or disrupt the lawful activities of the property owner or occupant. Unlike simple trespass, which typically involves unauthorised entry onto property, aggravated trespass involves a specific intent to cause harm or interference. This offence may include actions such as blocking access to premises, disrupting business operations, or engaging in threatening behaviour towards the property owner or occupants. Aggravated trespass laws vary by jurisdiction, but they are generally intended to protect the rights of property owners and maintain public order and safety. Penalties for aggravated trespass may include fines, imprisonment, or other legal sanctions, depending on the severity of the offence and the laws of the jurisdiction.

An offence under s.69 of the Criminal Justice and Public Order Act (1994). A person is guilty of aggravated trespass if he trespasses on another’s land (see: Trespass to land) and carries out any act with the intention of disrupting a lawful activity being carried out on or adjacent to that land.
