Non-feasance refers to a failure to act or fulfil a duty that one is legally obligated to perform. In legal contexts, non-feasance occurs when an individual or entity neglects to take action or carry out an obligation that they are required to do by law or contract. Unlike malfeasance, which involves wrongful or harmful actions, non-feasance involves the absence of action when action is required. Non-feasance can lead to legal liability if it results in harm or damages to others, especially if there is a duty of care owed to them.
